Terms of Service

These Terms of Service ("Terms") govern your access to and use of the fubbyllc.com website (the "Site") and the mobile applications operated by FUBBY LLC (the "Apps", and together with the Site, the "Services"). FUBBY LLC is a limited liability company registered in the State of Missouri, United States. By accessing or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account or use our Apps. By using the Services, you represent that you meet this requirement and that any information you provide is accurate.

2. Accounts

You are responsible for your account and for keeping your login credentials secure. You agree to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

3. Acceptable Use

When using the Services, you agree not to:

• Impersonate another person or misrepresent your identity or age;
• Harass, threaten, defraud or harm other users;
• Post or share content that is unlawful, hateful, sexually exploitative or otherwise violates our content rules;
• Use the Services for commercial solicitation, spam or advertising without our written consent;
• Attempt to gain unauthorized access to the Services, other accounts or our systems;
• Reverse engineer, scrape or interfere with the operation of the Services.

4. User Content

You retain ownership of the content you create and share through the Services. By posting content, you grant FUBBY LLC a non-exclusive, worldwide, royalty-free license to host, store, display and distribute that content as needed to operate the Services. We may remove content that violates these Terms or applicable law.

5. Purchases and Subscriptions

The Apps may offer digital subscriptions and in-app purchases. All purchases are processed by the app marketplace through which you downloaded the App (Apple App Store or Google Play) and are subject to that marketplace's payment terms and refund policies. Virtual items and credits have no cash value, are non-transferable and are not redeemable for money.

6. Safety

We work to keep the Services safe, including moderation and reporting tools, but we do not conduct criminal background checks on users. Use good judgment when interacting with people you meet through the Services, especially when sharing personal information or meeting in person.

7. Intellectual Property

The Services, including their software, design, trademarks and content (other than user content), are owned by FUBBY LLC or its licensors and are protected by intellectual property laws. You may not use them except as permitted by these Terms.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or that you will achieve any particular outcome from using them.

9. Limitation of Liability

To the fullest extent permitted by law, FUBBY LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the greater of one hundred US dollars (USD 100) or the amount you paid us in the twelve months before the claim arose.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services if you violate these Terms or where required by law. Sections that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Missouri, unless applicable law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows the latest revision. If changes are material, we will provide notice through the Services. Continued use after changes take effect constitutes acceptance of the updated Terms.
